Análisis del tribunal determinaron que en las pruebas presentadas se configura el delito como feminicidio, dijo Guadalupe ‘N’, hermana de la víctima; agregó al concluir la audiencia la tarde del miércoles que se ha logrado establecer la culpabilidad del acusado Carlos Alberto ‘N’.

El juzgador determinó que la sentencia se conocerá el próximo 6 de diciembre bajo la figura de feminicidio con dolo.

Informó que el juez puntualizó en el curso de la diligencia que para el dictamen de una sentencia en el caso, requirió como juzgador el ponderar la presunción de inocencia y las pruebas desahogadas en las audiencias de debate que demostraran fehacientemente el delito material sin basarse en presunciones y suposiciones, sino en hechos debidamente probados.

En consecuencia, el tribunal tuvo por acreditado el delito de feminicidio previsto y sancionado en el artículo 89 bis, fracciones segunda y tercera, en relación con los numerales 12 y 13, fracción primera 14, párrafo segundo del código Penal para el Estado Libre y Soberano de Quintana Roo.
